Summary Judgment Granted in favor of BP in Motors Insurance Company v. BP

Motors Insurance Company sued BP West Coast Products and Atlantic Richfield Company seeking subrogation for damage to automobiles at Comier Chevrolet, a large automobile dealership in Southern California. Motors alleged that fallout/flaring from BP refinery facilities caused substantial damage (acid rain) to new automobiles on Cormier's lot. The complaint alleged causes of action for private nuisance, trespass, negligence, strict liability for ultrahazerdous materials, and fraudulent concealment. Trial was set to commence on January 9th.  Steve Lamb, Marc Shrake, and Stephanie Lewis, through extraordinary legal maneuvering, gained admissions from Motors and convinced the Court to grant summary judgment on the eve of trial.
