Raven M. Atchison

Raven joined Zelle’s Dallas office in 2016. Her practice focuses on litigation and resolution of complex insurance and commercial business disputes. Prior to joining Zelle, Raven worked for Anderson & Riddle, LLP where she handled cases involving Insurance, General Litigation, Aerial Chemical Application, Products Liability and Civil Appeals.

In law school, Raven served as an Intern for the Honorable Judge Akers, interim for Judge Austin, at the Harris County Probate Court. She also had the opportunity to play volleyball as a Division 1 Student Athlete at Texas Tech University, before transferring to Texas A&M to finish her degree.

Representative Matters

Defended several aerial applicators in Arkansas when an herbicide distributor and its parent company were sued by several cotton farmers in federal district court in Arkansas. The aerial applicators that made the application were not parties to the suit and the distributor and its parent company were successful in the lawsuit. Then the distributor and its parent company sued the aerial applicators seeking attorneys fees for the defense in the underlying suit based on claims of negligence; Restatement (Second) of Torts § 914(2); indemnification under the third-party litigation exception; common law indemnification; and Arkansas Deceptive Trade Practices Act violations. Upon a Motion to Dismiss, the district court found in favor of the aerial applicators and on appeal, the Eighth Circuit affirmed the district court’s decision holding, among other things, that the aerial applicators did not owe a duty of care to the distributor and that Arkansas law does not recognize the third-party litigation exception to the American Rule.
