Court Dismisses Most of Northrop's Claims in Hurricane Coverage Suit

October 3, 2011

On September 28, 2011 U.S. District Judge Dean D. Pregerson dismissed seven of Northrop Grumman Corporation's eight remaining claims against Factory Mutual Insurance Company over nearly $1 billion in damage caused by Hurricane Katrina (Northrop Grumman Corporation v. Factory Mutual Insurance Company et al, No. 2:05-cv-08444). Judge Pregerson granted Factory Mutual's motion for partial summary judgment, finding that Northrop's claims of tortious breach of the covenant of good faith, misrepresentation and reformation could not stand. Zelle Hofmann Partners Thomas Cook, Jr., Shannon O'Malley and Patricia St. Peter represent Factory Mutual in the matter.
